Participant Waiver, Release of Liability, and Assumption of Risk
Mt. Pleasant Skyline UTV Weekend
September 11–12, 2026
In consideration for being permitted to participate in the Mt. Pleasant Skyline UTV Weekend, I acknowledge and agree to the following:
1. Voluntary participation
I understand that my participation, and the participation of any minor or passenger whom I register, is voluntary. I understand that this event involves guided travel in UTVs and other off-highway vehicles on public roads, unpaved roads, mountain roads, and designated motorized routes.
2. Assumption of risk
I understand that UTV and off-highway vehicle activities involve inherent and significant risks, including, but not limited to:
Collisions, rollovers, falls, and loss of vehicle control
Uneven, loose, steep, rocky, muddy, dusty, or slippery terrain
Washouts, ruts, potholes, cliffs, drop-offs, water crossings, and hidden obstacles
Mechanical failure, tire failure, fire, or fuel and fluid leaks
Contact with other vehicles, participants, animals, trees, rocks, or structures
Limited visibility caused by dust, weather, darkness, smoke, or terrain
Changing weather, lightning, wind, rain, snow, heat, cold, or wildfire
Delayed emergency response, limited cellular service, and remote locations
Acts or omissions of other participants, guides, volunteers, landowners, or members of the public
Serious bodily injury, permanent disability, paralysis, death, or property damage
I knowingly and voluntarily assume all risks associated with participation, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by Utah law.
3. Participant responsibility
I certify that:
I am physically and mentally capable of participating safely.
I will follow all applicable federal, state, county, city, and Forest Service laws and regulations.
I will follow all instructions given by event staff, guides, sweep riders, law enforcement, emergency personnel, and Forest Service personnel.
I will remain on designated routes and with my assigned group.
I will operate at a safe speed and maintain safe spacing.
I will not participate while impaired by alcohol, drugs, medication, fatigue, or any other condition that makes operation unsafe.
My vehicle is properly registered where required, appropriately insured, mechanically sound, and equipped for the route.
I am responsible for carrying adequate water, food, clothing, medication, fuel, recovery equipment, and personal supplies.
I understand that event staff may delay, reroute, shorten, or cancel any ride because of weather, fire restrictions, road conditions, emergencies, or Forest Service direction.
4. Safety equipment and minor participants
I agree that all occupants will use installed seat belts and safety restraints at all times.
I understand that persons under age 18 must comply with Utah helmet and OHV safety requirements. I am responsible for confirming that every minor whom I register has all legally required safety training, supervision, protective equipment, and authorization to operate or ride. Utah requires properly fitted, fastened, DOT-rated protective headgear for certain minors riding or operating specified OHVs on public land.
5. No medical personnel guaranteed
I understand that guides and volunteers are not necessarily trained medical professionals. Basic first-aid kits may be available, but immediate professional medical care may not be accessible. I authorize event personnel to contact emergency services and provide reasonable emergency assistance when necessary.
I accept responsibility for all medical, ambulance, rescue, evacuation, transportation, and treatment expenses incurred on my behalf or on behalf of any minor whom I register.
6. Release and waiver of claims
To the fullest extent permitted by law, I release and discharge:
Mt. Pleasant City
Its elected officials, employees, departments, agents, volunteers, guides, and sweep riders
The United States of America and the U.S. Forest Service
Event sponsors, contractors, caterers, participating businesses, landowners, and cooperating organizations
Each of their respective officers, employees, agents, representatives, successors, and assigns
from claims, demands, causes of action, damages, losses, or expenses arising from or related to my participation, including personal injury, death, or property damage, except to the extent that a claim cannot legally be waived.
7. Indemnification
To the fullest extent permitted by law, I agree to indemnify and hold harmless the released parties from claims, damages, costs, or expenses caused by:
My acts or omissions
My vehicle
My violation of event rules or applicable law
The acts or omissions of any minor or passenger whom I register
Damage I cause to persons, property, roads, trails, natural resources, or facilities
8. Property damage and vehicle responsibility
I understand that Mt. Pleasant City and the other released parties are not responsible for theft, loss, towing, breakdowns, mechanical repairs, vehicle damage, trailer damage, or damage to personal belongings.
I accept full responsibility for my vehicle and equipment.
9. Photo and media release
I authorize Mt. Pleasant City and its representatives to photograph, film, or record me and any minor participants whom I am legally authorized to register during the event.
I grant permission to use these images and recordings for city communications, event promotion, social media, tourism marketing, news coverage, and future event materials without compensation.
10. Event changes and cancellation
I understand that routes, schedules, meals, activities, and event operations may change because of weather, wildfire, road closures, safety concerns, government restrictions, or circumstances outside the organizer’s control.
Any refund policy will be governed by the event’s published registration and cancellation policy.
11. Governing law and severability
This agreement will be governed by Utah law.
If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
12. Acknowledgment
I certify that I have read this entire agreement, understand its terms, and understand that I am giving up substantial legal rights.
I sign voluntarily and without coercion.
