GENERAL RELEASE OF LIABILITY I, _______________________________________ (print full name) agree that I assume all risks of participating in all activities (“Activity”) being conducted by ___________________________________ at _______________________________________, including but not limited to any risks that could arise from negligence or carelessness of the Releasees identified below, from unsafe or defective equipment or property owned, maintained, or controlled by the Releasees, or arising from any potential strict liability.
I warrant that I am physically capable of and adequately prepared for participation in the Activity. I understand that the Activity carries intrinsic risks which cannot be eliminated, no matter the care taken.
I acknowledge that my participation is voluntary and I knowingly and intentionally assume all such risks. In consideration of my participation in the activity, I forever:
(1) WAIVE, RELEASE, AND DISCHARGE from any and all liability, including without limitation liability related to the negligence or fault of the entities or persons released, for my death, disfigurement, disability, personal injury, property damage or theft, or any actions which may harm or affect me, including my traveling to and from this activity, the following entities or persons: ______________________________________________________________________________ and/or their owners, directors, officers, employees, representatives, and agents (“Releasees”);
(2) INDEMNIFY, HOLD HARMLESS, AND AGREE NOT TO SUE the Releasees from and for any liabilities or claims made as a result of participation in the Activity, whether caused by negligence or otherwise.
I agree that the Releasees are NOT responsible for errors, negligence, carelessness, omissions, intentional acts, or failures to act of any party or entity conducting a specific activity on Releasee’s behalf.
I understand that the Activity brings with it the potential for serious bodily injury and property loss and I choose to participate anyway. I consent to receive any medical treatment which may be deemed appropriate in case of injury, accident, or illness during this activity.
I also agree to indemnify Releasees from any claims, actions, suits, costs, expenses, damages and liabilities including attorney fees as a result of my participation in the Activity.
I acknowledge that, while participating in this Activity, I may be photographed or videotaped. I agree to allow my photo, video, or audio likeness to be used for any legitimate purpose by the activity hosts, producers, sponsors, organizers, and assigns.
I agree that this Release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I have reviewed this document thoroughly and fully understand its terms. I know this is a release of liability and an enforceable contract and I sign it of my own free will.
