Cedar City Spring Fiesta – Event Liability Waiver and Release of Liability
1. Acknowledgment of Participation
I, the undersigned participant, vendor, exhibitor, contractor, volunteer, or attendee (“Participant”), acknowledge that I am voluntarily participating in the Cedar City Spring Fiesta (the “Event”). I understand that the Event includes a variety of activities and vendors, including but not limited to food sales, merchandise sales, service providers, demonstrations, entertainment, setup and teardown activities, and interaction with members of the public.
2. Assumption of Risk
I understand and acknowledge that participation in the Event involves inherent risks, both known and unknown, which may result in personal injury, illness, death, or property damage. These risks include, but are not limited to, slips and falls, food-related illness or allergic reactions, equipment failure, weather-related hazards, interaction with crowds or vehicles, acts or omissions of others, and conditions of city or state-owned property. I voluntarily assume all such risks.
3. Release and Waiver of Liability
To the fullest extent permitted by Utah law, I hereby release, waive, discharge, and covenant not to sue Cedar City Corporation, the City of Cedar City, the State of Utah, and their respective officers, employees, agents, representatives, volunteers, and affiliates (“Released Parties”) from any and all claims or liabilities arising out of or related to my participation in the Event, including claims caused by negligence.
4. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or expenses arising from my participation in the Event or my violation of this agreement or applicable law.
5. Vendor-Specific Acknowledgments (If Applicable)
Vendors acknowledge that alcohol, illegal drugs, and other restricted items under Utah law are prohibited. Vendors are solely responsible for their products, services, equipment, permits, licenses, insurance, and compliance with all applicable laws and regulations.
6. Medical Treatment
I consent to emergency medical treatment if necessary and understand that I am solely responsible for any medical costs incurred.
7. Insurance
I understand that no insurance coverage is provided by the Released Parties and that I am responsible for maintaining my own coverage.
8. Severability
If any provision of this waiver is held invalid, the remaining provisions shall remain in full force and effect.
9. Governing Law and Venue
This agreement shall be governed by the laws of the State of Utah, and venue shall lie exclusively in Utah.
10. Acknowledgment of Understanding
I have read this waiver, understand its terms, and voluntarily agree to be bound by it. I understand that I am waiving legal rights by signing below.
